Data protection is very important to us!

The protection of your personal data is taken very seriously when using this website. Below you will be informed about the collection, processing and use of your personal data when you visit this website and use the services offered there.

1. Information on Personal Data

Personal data is individual information relating to a person or that can be used to establish a connection to a person, such as their name, postal address, telephone number, email address, bank details, etc. Personal data can therefore, under certain circumstances, allow conclusions to be drawn about a person’s identity.

The Data Controller pursuant to Art. 4 (7) GDPR is:

Waldemar Behn GmbH Kadekerweg 2 24340 Eckernförde

Email: info@behn.de

You can reach our Data Protection Officer at:

datenschutz@behn.de

or at our postal address with the addition “the Data Protection Officer”

Maik Preißler c/o Vater Solution GmbH Boschstraße 5 24118 Kiel

2. Your Rights

  1. You have the following rights vis-à-vis a controller regarding the personal data concerning you:
  • Right to information,
  • Right to rectification or erasure,
  • Right to restriction of processing,
  • Right to object to processing,
  • Right to data portability.
  1. You also have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data.

You can find the contact details of the data protection supervisory authorities at the following link:

https://www.bfdi.bund.de/DE/Service/Anschriften/Laender/Laender-node.html

  1. Please send all information requests, requests for disclosure or objections regarding data processing by email to datenschutz@behn.de.

3. Contacting Us

When you contact us by email or via a contact form, the data you provide (your email address, and if applicable your name and phone number) is stored by us in order to answer your questions.

This data is processed on the basis of Art. 6 (1) (b) GDPR, if your inquiry relates to the fulfillment of a contract or is necessary for carrying out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us pursuant to Art. 6 (1) (f) GDPR, or on your consent pursuant to Art. 6 (1) (a) GDPR, if this was requested.

The data from your contact request remains with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your inquiry has been fully processed or a purchase contract has been concluded). Mandatory statutory provisions – in particular retention periods – remain unaffected.

We use service providers who work exclusively on our behalf and under our instructions to help provide the service offered, e.g. hosting our systems or operating our IT. These providers have been carefully selected by us and are regularly monitored.

As a general rule, we only store your data for as long as it is required for the respective purposes underlying the processing. Beyond that, we only store data to the extent that we are legally obliged to do so, e.g. due to statutory retention obligations.

4. Storage of Access Data

  1. Every time you access our website, access data is stored in a log file on our provider’s server.
  2. This record consists of, for example, your IP address, the date and time of the request, the name of the requested file, the amount of data transferred and the access status, a description of the web browser and operating system used, as well as the name of your internet service provider.
  3. This data is collected for technical reasons. It is evaluated exclusively for statistical purposes and without any reference to individuals (visitor numbers and page popularity). It is automatically deleted after 14 days at the latest.

5. Collection of Personal Data for Informational Use

  1. When you use the website purely for informational purposes, i.e. when you do not register, sign up or otherwise transmit information to us, we do not collect any personal data except for the data mentioned under item 5 that your browser transmits in order to technically enable you to visit the website.
  2. When using the website, so-called cookies are stored on your computer. Cookies are small text files that are stored on your hard drive, associated with the browser you use, and through which certain information flows to the party that sets the cookie (in this case, us). Cookies cannot run programs or transmit viruses to your computer. Here, they merely serve to make the overall website more user-friendly and effective. For example, we use cookies to identify you for repeat visits if you have an account with us. Otherwise, you would have to log in again for every visit.
  1. This website uses cookies to the following extent: – Transient cookies (temporary use) – Persistent cookies (use for a limited period of time)
  2. Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. These store a so-called session ID, which can be used to assign various requests from your browser to the shared session. This allows your computer to be recognized when you return to the website. Session cookies are deleted when you log out or close your browser.
  3. Persistent cookies are automatically deleted after a specified period, which can vary depending on the cookie. You can delete cookies at any time in your browser’s security settings.
  1. Mandatory functions technically necessary to display the website: The technical structure of the website requires us to use certain technologies, in particular cookies. Without these technologies, our website could not be displayed (fully correctly), or support functions might not be possible. These are generally transient cookies that are deleted after the end of your visit to the website, at the latest when you close your browser. You cannot opt out of these cookies if you wish to use our website. The individual cookies can be viewed in the consent manager.

Insofar as cookies are used, data processing is generally based on your consent pursuant to Section 25 (1) TDDDG in conjunction with Art. 6 (1) (a) GDPR. If we consider the use of cookies to be strictly necessary, data processing is based on Section 25 (2) No. 2 TDDDG. Further processing takes place pursuant to Art. 6 (1) (f) GDPR.

  1. Optional cookies subject to your consent: We only set various cookies with your consent, which you can select on your first visit to our website via the so-called cookie consent tool. These functions are only activated if you agree, and can in particular be used to analyze and improve visits to our website, make it easier for you to use the website across different browsers or devices, recognize you on a return visit, or serve advertising (possibly also to tailor advertising to your interests, measure the effectiveness of ads, or display interest-based advertising).

You may withdraw your consent at any time, without affecting the lawfulness of processing carried out based on the consent before its withdrawal.

A detailed description of the individual cookies as well as the status of your consent can be found on the page under the “Cookie Settings” tab.

5.1 Use of CCM19

Our website uses the consent manager CCM19 to obtain your consent for storing certain cookies on your device or for using certain technologies, and to document this consent in compliance with data protection law. When you enter our website, a connection is established to CCM19’s servers in order to obtain your consents and other declarations regarding the use of cookies. CCM19 then stores a cookie in your browser to be able to assign the consents you have granted, or their revocation, to you. The consent cookie is stored until you ask us to delete it, or you delete it yourself via CCM19, but for no longer than one year. You can make changes to consents already given and withdraw your consent via the “Cookie Settings” link at the bottom of your screen. The consent manager CCM19 is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6 (1) (c) GDPR.

The provider of the consent manager CCM19 is Papoo Software & Media GmbH, Auguststr. 4, 53229 Bonn (hereinafter “CCM19”).

6. Use of Social Media Plugins

  1. We currently use the following social media plugins: Facebook, Instagram, YouTube. We use links for this purpose. This means that when you visit our site, no personal data is generally transmitted to the providers of these plugins at first.

Personal data is only transmitted if you click on one of the plugins: activating the plugin automatically transmits data to the respective plugin provider, where it is stored (in the case of US providers, in the USA). We have no influence on the data collected and the data processing operations, nor are we aware of the full extent of the data collection, its purposes or the storage periods.

  1. If you activate a plugin, the plugin provider receives the information that you have accessed the relevant subpage of our online offering. In addition, the data mentioned under item 5 of this policy is transmitted, whereby in the case of Facebook, according to the respective provider, only an anonymized IP address is collected in Germany. This happens regardless of whether you have an account with this plugin provider and are logged in there. If you are logged in with the plugin provider, this data is assigned directly to your account. If you activate the button and, for example, share the page, the plugin provider also stores this information in your user account and shares it publicly with your contacts. If you do not want this to be associated with your profile with the plugin provider, you must log out before activating the button.
  2. The plugin provider stores this data as usage profiles and uses it for purposes of advertising, market research and/or the needs-based design of its website. Such an evaluation is carried out in particular (also for non-logged-in users) to display needs-based advertising and to inform other users of the social network about your activities on our website. You have a right to object to the creation of these user profiles, and to exercise this right you must contact the respective plugin provider.
  3. You can find further information on the purpose and scope of the data collection and its processing by the plugin provider in the privacy policies of these providers listed below. There you will also find further information on your rights in this regard and setting options to protect your privacy.
  4. Address of the respective provider and URL with their privacy notices:
  1. Facebook Inc., 1601 S California Ave, Palo Alto, California 94304, USA; http://www.facebook.com/policy.php; further information on data collection: http://www.facebook.com/help/186325668085084.
  2. Instagram LLC, 1601 Willow Road, Menlo Park, CA 94025, USA; https://help.instagram.com/519522125107875
  3. Youtube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA; https://www.google.de/intl/de/policies/privacy

your email address for the purpose of sending the newsletter. The legal basis is Art. 6 (1) (a) GDPR.

  1. Double opt-in: To sign up for our newsletter, we use the so-called double opt-in procedure. After you sign up, we send an email to the address provided. In this email, we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will be blocked and automatically deleted after one month. In order to be able to prove that you actually signed up for our newsletter and to be able to investigate any possible misuse of your personal data, we store the IP addresses you used as well as the times of registration and confirmation.
  2. Right of withdrawal: You may withdraw your consent to receive the newsletter and unsubscribe from it at any time. You can declare your withdrawal by clicking the link provided in every newsletter email or by sending a message to the contact details given in the legal notice. The lawfulness of any data processing already carried out remains unaffected by the withdrawal.
  3. Data processing on our behalf: We send our newsletter using the newsletter service CleverReach (Cleverreach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede, Germany). CleverReach transmits your name and email address solely for the purpose of us sending the newsletter. Your data is stored by CleverReach in such a way that other CleverReach customers or third parties have no access to it. You can find further information in CleverReach’s privacy policy.

8. Processing of Personal Data for Complaints and Grievances

We process personal data that we receive directly from you in connection with an inquiry, the conclusion of a contract or an ongoing business relationship. Processing takes place in order to carry out pre-contractual measures and to fulfill contracts, to comply with legal obligations, on the basis of your consent (which can be withdrawn at any time with effect for the future), and to safeguard legitimate interests, for example to assert or defend legal claims.

Your data may also be used for direct marketing, for example for postal information about products and services. You may object to this use at any time; following your objection, your personal data will no longer be processed for advertising purposes. To minimize payment defaults, a credit report may also be obtained from credit agencies in individual cases.

Depending on the type of business transaction, we process in particular master data, contact data, contract and billing data, payment information, correspondence and sales-related information. Within the corporate group, only those departments that need the data to perform their tasks are given access to it. In addition, service providers used by us, for example in the fields of IT, logistics or printing, as well as authorities or other bodies for law enforcement, may receive data insofar as this is necessary.

If service providers or partners outside the European Economic Area are used, it may be necessary to transfer personal data to third countries and process it there, insofar as this is necessary for services, hosting or support. Your data is only stored for as long as is necessary for the business relationship or due to statutory retention obligations, generally up to ten years; it is then deleted or blocked. No automated decision-making or profiling takes place.

9. Matomo

This website uses the open source web analytics service Matomo. Matomo uses technologies that enable cross-page recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting).

The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymized before storage. With the help of Matomo, we are able to collect and analyze data on how visitors use our website. This allows us, among other things, to find out when which page views were made and from which region they came. We also collect various log files (e.g. IP address, referrer, browser and operating system used) and can measure whether our website visitors carry out certain actions (e.g. clicks, purchases, etc.). This analysis tool is used on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. Insofar as corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG, to the extent that the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time. Your log-in data is automatically deleted after 180 days.

9.1 IP Anonymization

When analyzing with Matomo, we use IP anonymization. Your IP address is shortened before analysis, so that it can no longer be clearly assigned to you.

9.2 Hosting

We host Matomo exclusively on servers in the EU/EEA of our service provider domainfactory GmbH, which is bound by Art. 28 GDPR.

10. Use of Google reCAPTCHA

To ensure sufficient data security when submitting forms, we use the reCAPTCHA service provided by Google Inc. in certain cases. This is primarily used to distinguish whether an entry is made by a natural person or is the result of abusive, automated machine processing. The service includes sending the IP address and, where applicable, other data required by Google for the reCAPTCHA service to Google. Google Inc.’s separate privacy policy applies to this. You can find further information on Google Inc.’s privacy policies at: http://www.google.de/intl/de/privacy or https://www.google.com/intl/de/policies/privacy/

11. Use of DOUBLECLICK BY GOOGLE

Doubleclick by Google is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Doubleclick by Google uses cookies to show you advertisements that are relevant to you. In doing so, your browser is assigned a pseudonymous identification number (ID) in order to check which ads were displayed in your browser and which ads were clicked on. The cookies do not contain any personal information. The use of DoubleClick cookies merely enables Google and its partner websites to place ads based on previous visits to our website or other websites on the internet. The information generated by the cookies is transferred by Google to a server in the USA for evaluation and stored there. Google only transfers data to third parties on the basis of statutory provisions or as part of data processing on our behalf. Under no circumstances will Google combine your data with other data collected by Google. By using our websites, you agree to the processing of the data collected about you by Google in the manner described above and for the stated purpose. You can prevent the storage of cookies by setting your browser software accordingly; however, please note that in this case you may not be able to use all functions of our websites to their full extent. You can also prevent Google from collecting the data generated by the cookies and related to your use of the website, as well as Google’s processing of this data, by downloading and installing the browser plug-in available at the following link under “DoubleClick opt-out extension”.

12. Facebook Pixel

We use the Facebook pixel from Facebook on our website. For this purpose, we have implemented a code on our website. The Facebook pixel is a snippet of JavaScript code that loads a collection of functions with which Facebook can track your user actions, provided you came to our website via Facebook ads. For example, if you purchase a product on our website, the Facebook pixel is triggered and stores your actions on our website in one or more cookies. These cookies allow Facebook to match your user data (customer data such as IP address, user ID) with the data from your Facebook account. Facebook then deletes this data again. The data collected is anonymous and not visible to us and can only be used in connection with placing advertisements. If you are a Facebook user yourself and are logged in, your visit to our website is automatically assigned to your Facebook user account.

We only want to show our services or products to people who are genuinely interested in them. With the help of the Facebook pixel, our advertising measures can be better tailored to your wishes and interests. This means Facebook users (provided they have allowed personalized advertising) are shown matching ads. Facebook also uses the collected data for analysis purposes and its own advertisements.

If you are logged in to Facebook, you can change your ad settings yourself at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. If you would like to learn more about Facebook’s data protection practices, we recommend the company’s own data policy at https://www.facebook.com/policy.php.

Please send your objection to the email address datenschutz@behn.de
